These Terms & Conditions ("Terms") govern your use of the 57 Services website at 57services.com ("Site") and the excavation, dumpster rental, septic, and porta potty services we provide ("Services"). By accessing the Site, requesting a quote, or engaging us, you agree to these Terms. If you do not agree, please do not use the Site or our Services.

1. About Us

57 Services is a construction support services company operating in North Texas, specializing in excavation and site work, roll-off dumpster rental, septic installation and maintenance, and portable restroom rental.

2. Use of the Site

You agree to use the Site lawfully and not to: (a) interfere with or disrupt its operation; (b) attempt to gain unauthorized access; (c) scrape, copy, or republish content without written permission; (d) upload harmful code; or (e) use the Site to harass others or violate any law. All text, images, logos, and materials on the Site are owned by 57 Services or its licensors and are protected by copyright and trademark law.

3. Quotes, Estimates & Proposals

Quotes are based on the information you provide and, when applicable, an on-site assessment. Quotes are valid for 30 days unless stated otherwise. Pricing may be adjusted if scope, soil conditions, access, site conditions, materials, weight limits, or specifications differ from what was originally described. Submitting a request through the Site, by phone, or by email is not a binding agreement; a binding contract is formed only when a written proposal, work order, or service agreement is signed or accepted in writing by both parties.

4. Scheduling, Delivery & Site Access

Delivery and service windows are estimates and may be affected by weather, equipment availability, permits, and conditions beyond our reasonable control. The customer is responsible for: (a) providing a safe, level, and accessible drop location free of low wires and obstructions; (b) ensuring legal authority to place equipment at the location; (c) obtaining any required permits from the city, county, or HOA; and (d) protecting underlying surfaces (concrete, asphalt, landscaping). We are not liable for damage to driveways, sidewalks, irrigation, septic lines, or unmarked underground utilities resulting from access we were directed or permitted to use.

5. Dumpster Rentals — Acceptable Use

  • Do not exceed posted weight limits or fill above the container's top rail.
  • Prohibited materials include, but are not limited to: hazardous waste, liquids, paints, solvents, oils, batteries, tires, asbestos, medical waste, refrigerants, and other items restricted by landfill or regulation.
  • Overweight loads, prohibited materials, or trips made when the container is blocked or inaccessible may result in additional fees including overage, trip, contamination, or disposal charges.
  • The customer is responsible for the container and its contents from delivery until pickup.

6. Septic Services

Septic installations, repairs, and maintenance are performed in accordance with applicable Texas Commission on Environmental Quality (TCEQ) rules and local authority requirements. Designs, permits, and inspections required by the authority having jurisdiction may affect schedule and cost. The customer is responsible for accurate disclosure of system location, age, and prior service history.

7. Porta Potty Rentals

Units are delivered clean and serviced on the schedule stated in your agreement. The customer is responsible for reasonable care of the unit while on site. Damage caused by vandalism, tipping, fire, or misuse may incur repair or replacement charges.

8. Payments

Payment terms are stated on your proposal or invoice. A deposit may be required to schedule work. Unless otherwise agreed in writing, invoices are due upon receipt. Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum rate allowed by Texas law, and we may suspend service or recover equipment until paid. The customer agrees to pay reasonable collection costs and attorneys' fees incurred to collect past-due amounts.

9. Cancellations & Changes

Cancellations made before dispatch are generally not charged. Cancellations after a truck has been dispatched may incur a trip fee. Recurring services can be cancelled with the notice period stated in the signed agreement.

10. Performance & Concerns

We are committed to professional, safe, and dependable work. If you have any concern about our Services, please notify us within 24 hours of completion so we can promptly investigate and make it right.

11. Warranties & Disclaimers

We perform Services in a workmanlike manner consistent with industry standards in North Texas. EXCEPT AS EXPRESSLY STATED IN A SIGNED AGREEMENT, THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND 57 SERVICES DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 57 SERVICES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR YOUR USE OF THE SITE WILL NOT EXCEED THE AMOUNTS PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 60 DAYS PRECEDING THE EVENT.

13. Indemnification

You agree to defend, indemnify, and hold harmless 57 Services and its owners, employees, and contractors from any claims, damages, losses, and reasonable attorneys' fees arising out of (a) your breach of these Terms, (b) your provision of inaccurate site or project information, (c) your misuse of the Site or equipment, or (d) any third-party claims relating to your project.

14. Insurance & Force Majeure

57 Services maintains general liability insurance appropriate to the Services provided. We are not responsible for delays or failures caused by events beyond our reasonable control, including weather, acts of God, accidents, supplier failures, labor disruptions, permitting delays, or government action.

15. SMS / Text Messaging Terms (Help Message)

Program: 57 Services sends transactional and customer-care SMS messages (quote follow-ups, scheduling, delivery and pickup confirmations, service reminders, and account updates) to customers who have opted in.

16. Privacy

Use of the Site is also governed by our Privacy Policy. By using the Site, you consent to the practices described there.

17. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Exclusive venue for any dispute is the state or federal courts located in North Texas, and you consent to that jurisdiction.

18. Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted on this page. Your continued use of the Site or Services after a change means you accept the revised Terms.
